Terms and Conditions
These Terms govern access to and use of the Vivi’s Custom Exteriors website. They do not replace the terms of any signed proposal, roofing contract, warranty, financing agreement, change order, or other written agreement.
Agreement to These Terms
By accessing or using this website, you agree to these Terms and the Vivi’s Custom Exteriors Privacy Policy. If you do not agree, do not use the website.
These Terms apply to visitors and users of the website operated by Vivi’s Custom Exteriors. They govern website use, online forms, general service information, and website-based communications.
If you request or purchase roofing, gutter, soffit, fascia, storm, commercial roofing, or related services, the signed proposal, contract, change order, warranty, financing agreement, or other project-specific document controls if it conflicts with these website Terms.

Estimates, Inspections, and Service Information
Website content is general information. It is not a diagnosis of a roof, gutter, exterior, structural, moisture, or building condition. It is also not a binding quote, insurance coverage decision, engineering opinion, legal opinion, public-adjusting service, or guarantee that a particular product or service is appropriate for your property.
Online requests, price ranges, form responses, appointment requests, preliminary observations, and general recommendations are not binding unless Vivi’s expressly states otherwise in a written agreement.
Final project terms are established in the applicable written agreement and may include:
- The approved roof or exterior areas and scope of work.
- Materials, colors, manufacturers, assemblies, and installation details.
- Project price, deposit, payment schedule, financing, and change-order terms.
- Permits, inspections, access, property protection, cleanup, scheduling, and owner responsibilities.
- Treatment of concealed deterioration, damaged decking, wet insulation, code-required corrections, or other conditions not visible before work begins.
- Workmanship warranties, manufacturer warranties, exclusions, limitations, and closeout documentation.
Service areas, project availability, material availability, and completion times may change. Scheduling may be affected by weather, permitting, inspections, hidden conditions, supplier delays, change orders, safety concerns, occupied-property restrictions, or events beyond reasonable control.
Communications About Your Request
When you provide contact information, you authorize Vivi’s and its communication service providers to contact you about the inquiry, appointment, inspection, estimate, proposal, project, payment, warranty, or service relationship you initiated.
Contact may occur by telephone call, text message, or email using the information you provide. Some communications may be sent through automated customer-management or messaging tools.
Marketing calls or text messages will be sent only when permitted by applicable law and, when required, after the appropriate consent is obtained. Consent to marketing is not a condition of purchasing services.
Message frequency varies. Message and data rates may apply. You may opt out of text messages by replying STOP or by communicating another reasonable request to stop. Reply HELP for assistance. Marketing email may be stopped through the unsubscribe method provided in the message.
Vivi’s may continue sending non-marketing communications concerning an active inquiry, appointment, estimate, project, payment, warranty, safety issue, or legal obligation.
You are responsible for providing accurate contact information and confirming that you are authorized to use the telephone number and email address submitted.
Intellectual Property and Acceptable Use
The website and its original text, graphics, logos, photographs, videos, design, layout, downloadable materials, and other content are owned by or licensed to Vivi’s Custom Exteriors and are protected by applicable intellectual-property laws.
You may view and print reasonable portions of the website for personal, noncommercial use related to evaluating Vivi’s services.
You may not reproduce, republish, sell, license, modify, distribute, publicly display, create derivative works from, remove ownership notices from, frame, mirror, or commercially exploit website content without prior written permission from Vivi’s or the applicable rights holder.
If you provide a review, testimonial, photograph, video, project description, or other material for possible publication, you represent that you have the right to provide it. Any separate written release, authorization, or content agreement controls Vivi’s right to publish or use that material.
Third-Party Websites and Services
The website may link to or embed third-party maps, contact forms, customer-management tools, payment processors, financing resources, manufacturers, review platforms, social networks, videos, scheduling tools, advertising platforms, or other content.
Those services are controlled by third parties and may have separate terms, privacy policies, eligibility requirements, fees, security practices, and availability rules.
Vivi’s does not control and is not responsible for the availability, security, accuracy, content, products, policies, decisions, or conduct of a third-party service. A link, integration, logo, or embedded feature does not necessarily mean Vivi’s endorses every statement, product, or practice of that third party.
Review the applicable third-party terms before using a financing application, payment tool, map, social platform, embedded form, or other external service.
Disclaimer of Warranties
To the maximum extent permitted by law, the website is provided on an “as is” and “as available” basis.
Vivi’s disclaims warranties relating to the website, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and freedom from harmful components.
Vivi’s does not warrant that the website will be uninterrupted, error-free, completely secure, current at all times, compatible with every device, or that every defect will be corrected.
Vivi’s does not warrant that website content, an online form, an appointment request, a product description, a financing link, or general service information will be appropriate for every user or property.
These website disclaimers do not eliminate warranties or obligations that cannot legally be excluded and do not replace an express written warranty provided under a signed project agreement.
Limitation of Liability
To the maximum extent permitted by law, Vivi’s Custom Exteriors and its owners, employees, affiliates, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of, or inability to use, the website or a third-party service linked through it.
To the maximum extent permitted by law, Vivi’s aggregate liability arising solely from use of the website will not exceed the greater of the amount you paid directly through the website for the matter giving rise to the claim or $100.
This limitation does not apply where prohibited by law and does not alter liability, remedies, warranty obligations, or damage limitations governed by a separate signed agreement.
You agree to be responsible for losses, claims, liabilities, and reasonable expenses arising from your unlawful misuse of the website, violation of these Terms, false submission, or infringement of another person’s rights, to the extent permitted by law.
Governing Law, Disputes, and Severability
These Terms and use of the website are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
Before filing a claim relating to the website, you agree to contact Vivi’s and make a good-faith effort to resolve the concern informally.
Unless a separate written agreement or applicable law requires otherwise, legal proceedings concerning these website Terms shall be brought in a state or federal court of competent jurisdiction serving Marion County, Indiana.
If a provision of these Terms is held unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
Failure to enforce a provision is not a waiver of the right to enforce it later. These Terms, the Privacy Policy, and any applicable signed agreement constitute the relevant agreement for the matters each document covers.
Changes to These Terms
Vivi’s may update these Terms as the website, services, communication tools, vendors, business practices, or legal obligations change.
Changes become effective when the revised Terms are posted on this page unless a later effective date is stated. The “Last Updated” date near the top of the page identifies the latest revision.
Continued use of the website after revised Terms are posted means you accept the revised Terms. A revision to these website Terms does not automatically change an existing signed proposal, contract, warranty, financing agreement, or change order.
